1. Acceptance of Terms
These Terms of Use ("Terms") form a binding agreement between you and My Global Tote LLC ("MyGlobalTote," "we," "us"). By creating an account or otherwise accessing or using the MyGlobalTote website, dashboard, or browser extension (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Cookie Policy, and Affiliate Disclosure, each of which is incorporated herein by reference. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (16 in the EEA) to use the Service. If you are between 13 (or 16 in the EEA) and the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements and have the legal capacity to enter into these Terms. The Service is not intended for use in any jurisdiction where its use would violate applicable law, and we reserve the right to restrict access to the Service from any jurisdiction at our sole discretion.
3. Your Account
You are responsible for keeping your credentials confidential and for all activity that occurs under your account. You agree to provide accurate information at signup and to keep it current. You must notify us immediately of any unauthorized access to or use of your account.
You may delete your account at any time through your account settings or by contacting us at the email listed in Section 18 below. Upon account deletion, your data will be handled in accordance with our Privacy Policy.
We reserve the right to reclaim, reassign, or suspend usernames or accounts that are inactive for extended periods, that infringe or appear to infringe third-party trademarks, or that violate these Terms.
4. The Service
MyGlobalTote lets you save, organize, and revisit product information from across the web. Product details (titles, prices, availability, images) are sourced from third-party websites and may change or be inaccurate. We make no representations or warranties regarding the accuracy, completeness, or reliability of any product information displayed through the Service. You should verify all information directly with the relevant retailer before making any purchase decision. We are not a retailer, broker, or agent for any product or store, and we do not process purchases.
We reserve the right to modify, suspend, or discontinue the Service (or any part or feature thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
5. Browser Extension
The browser extension reads metadata from product pages you visit only when you choose to save an item. The extension requests access only to the active tab when you initiate a save action. It does not passively browse, collect browsing history, capture form data or keystrokes, or access pages you do not explicitly save. Use of the extension is also subject to your browser vendor's terms and policies. You may uninstall the extension at any time.
The extension may update automatically through your browser's extension update mechanism. Continued use of the extension after an update constitutes acceptance of any revised functionality. If you do not agree with an update, you may uninstall the extension.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any third-party rights (including intellectual property, privacy, and publicity rights).
- Scrape, crawl, spider, or use any automated means (including bots, robots, or scripts) to access the Service, except as expressly permitted through a published API, if applicable.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- Attempt to gain unauthorized access to the Service, its servers, networks, or any associated systems or databases.
- Interfere with or disrupt the Service, its servers, or networks connected to the Service.
- Upload, transmit, or distribute malware, viruses, spam, or any other harmful or disruptive content.
- Resell, sublicense, or commercially redistribute the Service or access thereto without our prior written consent.
- Save, store, or share content that is defamatory, obscene, or that infringes the intellectual property rights of any third party.
Violations of this Section 6 may result in immediate suspension or termination of your access to the Service, removal of content, and potential legal action.
7. Your Content
You retain ownership of the items, notes, and information you save to the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, display, and create derivative works of Your Content solely as needed to provide, maintain, improve, and promote the Service (for example, generating thumbnails, search indexing, or sharing previews). You also grant us the right to create and use aggregated, de-identified data derived from Your Content as described in our Privacy Policy.
The license granted in this section terminates when you delete Your Content or your account, except with respect to (a) aggregated, de-identified data as described in our Privacy Policy, which may be retained indefinitely, and (b) copies that may persist in encrypted backup systems for a limited period as described in our Privacy Policy.
You represent and warrant that Your Content does not violate any third-party rights (including intellectual property, privacy, and publicity rights), does not contain anything unlawful, and that you have all rights necessary to grant the licenses in this section.
8. Intellectual Property
The Service, including its design, code, logos, trademarks, and content (excluding Your Content), is owned by us or our licensors and is protected by applicable intellectual property laws. "MyGlobalTote" and associated logos are trademarks or service marks of My Global Tote LLC. Nothing in these Terms grants you any right to use our trademarks without our prior written consent.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes in accordance with these Terms. This license does not include any right to resell or commercially exploit the Service or its content, to collect or use any product listings or descriptions for purposes unrelated to your use of the Service, or to download or copy the Service (other than page caching).
Feedback. If you provide us with any feedback, suggestions, ideas, or recommendations regarding the Service ("Feedback"), you hereby assign to us all right, title, and interest in such Feedback. We are free to use, incorporate, and commercialize Feedback without any obligation of compensation, attribution, or restriction.
Copyright and Intellectual Property Claims. If you believe that content on the Service infringes your intellectual property rights, please submit a notice using our copyright / DMCA takedown form or by emailing the address listed in Section 17 below with the following information: (a) identification of the copyrighted work or intellectual property claimed to be infringed; (b) identification of the material on the Service alleged to be infringing and information sufficient to locate it; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized by the rights owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the rights owner; and (f) your physical or electronic signature. We will respond to valid notices in accordance with applicable law, including the Digital Millennium Copyright Act (17 U.S.C. § 512).
9. Third-Party Links and Retailers
The Service contains links to third-party websites. We are not responsible for their content, products, prices, availability, or privacy practices. The inclusion of any third-party link does not imply endorsement, sponsorship, or recommendation by MyGlobalTote. Your transactions with third-party retailers are solely between you and them, and we shall have no liability or responsibility in connection with such transactions.

10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT PRODUCT INFORMATION WILL BE ACCURATE OR CURRENT. PRODUCT INFORMATION (INCLUDING PRICES, IMAGES, AND DESCRIPTIONS) IS PROVIDED BY THIRD-PARTY RETAILERS, AND WE DO NOT VERIFY THIS INFORMATION.
WE DO NOT WARRANT THAT YOUR SAVED ITEMS OR DATA WILL BE PRESERVED INDEFINITELY. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF ANY INFORMATION THAT IS IMPORTANT TO YOU.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN SUCH JURISDICTIONS, THE FOREGOING EXCLUSIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS AS A CONSUMER.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MYGLOBALTOTE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY FOR (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, (B) FRAUD OR FRAUDULENT MISREPRESENTATION, OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR CAPS ON LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
12. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless MyGlobalTote and its officers, directors, employees, agents, and partners from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
We will provide you with prompt written notice of any such claim and will cooperate reasonably with you in the defense of such claim. You shall not settle any claim that imposes obligations on us without our prior written consent.
This indemnification obligation does not apply where prohibited by applicable law, including in jurisdictions where indemnification provisions in consumer contracts are unenforceable.
13. Termination
You may stop using the Service and delete your account at any time through your account settings or by contacting us. We may suspend or terminate your access immediately and without prior notice if you violate these Terms. We may also terminate your access for any other reason at our discretion; where reasonably practicable, we will provide notice before doing so.
Upon termination for any reason: (a) your license to use the Service terminates immediately; (b) you must cease all use of the Service; and (c) your data will be handled in accordance with our Privacy Policy, including deletion of personal information within 30 days of account termination except as otherwise described therein.
The following sections survive termination of these Terms: Section 7 (Your Content — license and representations), Section 8 (Intellectual Property — feedback and ownership), Section 10 (Disclaimers), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 14 (Governing Law and Disputes), and Section 16 (General Provisions).
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of laws principles.
Informal Resolution. Before initiating any formal proceeding, you agree to first contact us at the email listed in Section 18 and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved within that period, either party may proceed as set forth below.
Binding Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in the English language and shall take place in Dallas County, Texas, or at another mutually agreed location. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator shall have the authority to award any relief that a court of competent jurisdiction could award.
Class Action Waiver. YOU AND MYGLOBALTOTE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
Small Claims Court. Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.
30-Day Opt-Out Right. You may opt out of this arbitration provision by sending written notice to us at the email listed in Section 18 within 30 days of first accepting these Terms. Your notice must include your name, account email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction there.
EU/UK Consumer Rights. If you are a consumer in the European Economic Area or United Kingdom, nothing in this section deprives you of the protection of the mandatory provisions of the law of your country of residence or your right to bring proceedings in the courts of your country of residence. The arbitration provision and class action waiver in this section do not apply to you to the extent they are unenforceable under the laws of your jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the revised Terms on this page with a new "Last updated" date and, where reasonably practicable, notify you by email or in-app notification. Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of those revised Terms. If you do not agree with the revised Terms, your sole remedy is to stop using the Service and delete your account.
16. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy, Cookie Policy, and Affiliate Disclosure, constitute the entire agreement between you and MyGlobalTote with respect to the Service and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral.
Severability. If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent to the greatest extent possible.
Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at any later time.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely, including in connection with a merger, acquisition, reorganization, or sale of assets, without notice to or consent from you.
Force Majeure. We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet or telecommunications outages, cyberattacks, labor disputes, or failures of third-party services on which we rely.
Electronic Communications. By using the Service, you consent to receive communications from us electronically (including by email and in-app notifications). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
